Notice to Clarendon CISD School Health Advisory Committee (SHAC)
Texas law (Agriculture Code, Title 2, Chapter 12 Section 12.0029) requires public school food authorities with 50% or more of enrolled students eligible for free or reduced-price meals in the National School Lunch Program to operate a Summer Nutrition Program to provide meals to students in need for a minimum of 30 calendar days during the summer months. Because Clarendon CISD meets this requirement, we have 3 options:
- Operate a Summer Nutrition Program
- Partner or collaborate with another organization to support their summer program
- Request and receive approval for a waiver for participation
The last few years, CCISD has requested and received a waiver citing transportation challenges as the reason, which is a viable option for the request according to the Texas Department of Agriculture, for not participating in the summer program. CCISD is desiring to request the waiver again, stating that there are insurmountable obstacles to program operations, citing the following explanation:
"We are a Consolidated School District in a rural area, in addition to the students that live in the country, we also have students that live in a defined Hazardous Area that is less than 2 miles from the school and must cross the 5-lane, US Highway 287 and a very busy set of railroad tracks. There are no crosswalks on the highway and an extremely limited number of sidewalks throughout our town. In order to access the meal site, students would have less than 2 blocks of sidewalks leading to the school. Safety hazards include: US Highway 287, Railroad Tracks - Burlington Northern. Clarendon, Texas does not have the availability of free public transportation."
This year, TDA is requiring that the board of trustees send a written notice of the district's intention to the local SHAC with an explanation of the district's reason for requesting a waiver of requirement. This notice serves that purpose.
